3.2 Eligibility Restrictions

ShellTime reserves the right, at its sole discretion, to determine that certain organizations fall outside the intended user base of the Service ("Designated Organizations"). Such determinations may be made and revised at any time without prior notice.

3.4 Enforcement and Termination for Convenience

ShellTime reserves the right to terminate or suspend any account at any time, for any reason or no reason, at its sole discretion, with or without notice. Without limiting the foregoing, accounts found to be ineligible under this Section 3 may be terminated. In the event of such termination:

• All access to the Service shall be revoked.
• Any prepaid fees or subscription payments shall be non-refundable to the extent permitted by applicable law.

Providing false or misleading information regarding one's identity, employer, or role in connection with account registration constitutes a material breach of these Terms.

3.5 Appeals and Review

Any individual who believes their account has been incorrectly affected by this Section 3 may submit a written inquiry to ShellTime at the contact information provided in Section 9. ShellTime shall consider such inquiries in good faith; however, all final eligibility determinations remain at the sole discretion of ShellTime.

4. Data Collection and Privacy

We collect and process personal data in accordance with our Privacy Policy. By accessing or using the Service, you acknowledge and consent to the collection, use, and processing of your data as described therein. Our Privacy Policy is hereby incorporated into these Terms by reference.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHELLTIME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SHELLTIME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
